1. Who we are and acceptance of these terms
TopekaLocals.com (the “Site”) is owned and operated by SEM By Design (“SEM By Design”, “we”, “us” or “our”), 7825 S 94th St, La Vista, NE 68128. You can reach us at info@topekalocals.com.
By using the Site, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site. Our Privacy Policy explains how we handle information and is part of how the Site works.
You must be at least 18 years old to create an account or submit a listing.
2. What the directory is and is not
TopekaLocals.com is a local directory of home-service businesses in Topeka, Kansas and nearby communities. It helps you find and contact businesses.
The directory is for information only. Please keep these points in mind:
- No endorsement. A listing is not a recommendation or an endorsement of any business. Badges such as “New” or “Popular” are labels on the Site. They are not a measure of quality.
- No guarantees. We do not guarantee the quality, safety, licensing, insurance, bonding, pricing, availability, reliability or results of any business listed.
- Do your own checks. Before you hire anyone, verify their license, insurance and references directly with the business and with the right licensing authority. Get written estimates and contracts.
- Compiled listings. Many listings were compiled by SEM By Design from public sources, such as each business’s own website and public directories. We try to verify them as best we can. We did not charge those businesses to appear.
- “Verified” badge. Where the Site shows a “Verified” badge, it means the business owner has claimed the listing and confirmed the listing details. It is not a license check, an insurance check or a quality check. We have not checked the business’s license, insurance, work quality or reputation.
3. We are not a contractor and not a party to your deal
SEM By Design does not perform home services. We are not a contractor, broker, agent or referral guarantor for any business in the directory.
Any agreement, payment, warranty or dispute is between you and the business. SEM By Design is not a party to it and is not responsible for it. If something goes wrong with a business you found here, you will need to resolve it with that business or through the proper legal channels.
4. Accuracy of listings, corrections and removal requests
Business information changes. Phone numbers, addresses, hours, services and ownership can be out of date or wrong. We do not promise that any listing is complete, current or error-free.
If you see something wrong, or if you want a listing corrected or removed, email info@topekalocals.com. Please include:
- the name of the business and the link to the listing
- what is wrong and what it should say, or that you want it removed
- if you are asking on behalf of the business, your name and your role there
We will respond to correction and removal requests within 3 business days. We may ask you to confirm that you are connected to the business. We decide whether to correct, keep or remove a listing, and we may remove a listing at a business’s request.
Listing pages also have a “Report Abuse” form. Either the form or email is a valid way to ask for a correction or removal.
5. Accounts and security
Some features, such as adding or claiming a listing, need an account. When you create one:
- Give accurate information and keep it up to date.
- Keep your password private. You are responsible for activity under your account.
- Tell us right away at info@topekalocals.com if you think someone else has used your account.
- Do not share your account or create accounts for people who have not agreed.
We may suspend or close an account that breaks these Terms or puts the Site or other people at risk.
6. Business owner terms
These terms apply if you submit a listing or claim one.
Authority. You promise that you own the business or are authorized to act for it, and that you can agree to these Terms for it.
Accuracy. You promise that the information you submit is true, current and not misleading. This includes the business name, contact details, address, services, licenses and any claims you make about the business. Do not claim a license, certification, insurance or award you do not hold. You must tell us if something changes.
Claiming a listing. An owner can claim an existing listing by creating an account and submitting the claim form on that listing. The form asks for details such as your name, phone number and information we can use to check your connection to the business. We may approve, reject or ask for more information on any claim, and we decide how much verification to require. We may reverse an approved claim if we learn it was not valid. Approval of a claim does not mean we endorse the business.
License to us. You keep ownership of what you submit (text, photos, logos and other material). You give SEM By Design a free, worldwide, non-exclusive license to use, host, copy, display, edit, format and share that material on and in connection with the Site and its promotion. You promise you have the right to give us this license.
Our rights. We may edit, reject, suspend or remove any listing, claim or content at any time, with or without notice, for example if it is inaccurate, misleading, duplicated, unlawful, harmful or breaks these Terms.
Fees. Listings are free at this time. If we offer paid services, including paid placement, we will describe the price and terms to you separately before you pay. Nothing is owed unless you agree to it in writing.
7. User content and reviews
If we add reviews or ratings to the Site, the rules in this section will apply to them. Reviews and ratings are not a feature of the Site today.
If the Site lets you post content such as reviews, ratings, comments or reports, you are responsible for what you post. Post only what is true and based on your own experience. Do not post anything unlawful, defamatory, fake or misleading, and do not post reviews of your own business or of a competitor to gain an advantage. You give SEM By Design a free, worldwide, non-exclusive license to display and use what you post on the Site. We may remove content at our discretion. Opinions in user content belong to the people who wrote them, not to SEM By Design.
8. Acceptable use
You agree not to:
- break any law or the rights of others
- submit false, misleading or spam information, or impersonate a person or business
- scrape, copy or collect listings or contact details in bulk, or use them to send unsolicited marketing
- use the Site to harass, threaten or defraud anyone
- upload malware, or try to break, overload or gain unauthorized access to the Site or its accounts
- bypass any security, rate limit or access control
- use the Site in any way that could harm SEM By Design or its users
9. Intellectual property and trademarks
The Site’s design, text, layout and software belong to SEM By Design or its licensors and are protected by law. You may use the Site for your own personal or business-research purposes. You may not copy or resell it without our written permission.
Business names, logos and trademarks shown on the Site belong to their owners. We display them only to identify the business in its listing. Their use does not mean the owner sponsors or endorses the Site, or that we are affiliated with them. If you own a mark shown on the Site and want it changed or removed, email info@topekalocals.com.
10. Third-party sites and links
Listings and pages link to websites and services we do not run, such as a business’s own website, Google Maps and social sharing buttons. We do not control them and are not responsible for their content, practices or availability. Their own terms and privacy policies apply when you use them. A link is not an endorsement.
11. Featured and promoted placement
Nothing on the Site is paid for today. In the future, some placements, such as top spots in a category, may be paid for or included with another service from SEM By Design.
- If a placement is paid for, we will label it.
- A placement is not an endorsement. It is not a ranking of quality.
- We may change or end any placement at any time.
12. Advertising and analytics
We use Google Analytics 4 on the Site to measure how it is used. It may use cookies and similar technologies. We may use advertising and measurement tools in the future. If we do, we will update our Privacy Policy first. The Privacy Policy explains what is collected, how it is used and the choices you have.
13. Disclaimers
The Site and everything on it are provided “as is” and “as available”. To the fullest extent the law allows, SEM By Design disclaims all warranties, express or implied. This includes warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available, secure or free of errors, or that any listing or information is accurate or current. You use the Site and deal with any business at your own risk.
14. Limitation of liability
To the fullest extent the law allows, SEM By Design and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost business. We are also not liable for any loss or damage from work done, or not done, by any business listed on the Site.
Our total liability to you for any claim related to the Site will not be more than the greater of the amount you paid us for the Site in the 12 months before the claim or $100.
Some places do not allow certain limits. In those places, our liability is limited as far as the law permits.
15. Indemnity
You agree to defend and hold harmless SEM By Design and its owners, employees and contractors from claims, losses and costs (including reasonable attorney fees) that come from your use of the Site, content or listing information you submit, your breach of these Terms or your violation of anyone’s rights.
16. Termination
You may stop using the Site at any time. You may ask us to close your account or remove your listing by emailing info@topekalocals.com. We may suspend or end your access, or remove your listings and content, at any time if we believe you broke these Terms or if we need to protect the Site or others. Sections that by their nature should continue (such as the license, disclaimers, limits of liability, indemnity and governing law) continue after termination.
17. Changes to these terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top. Your continued use of the Site after a change means you accept the updated Terms. If a change is significant, we will try to give notice on the Site.
18. Governing law and venue
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict of laws rules. Any dispute about these Terms or the Site will be brought in the state or federal courts located in Sarpy County, Nebraska, and you agree to those courts’ jurisdiction.
